Bank of New York Mellon, fearful of being sued by Argentine bondholders and unwilling to defy a court order blocking their coupon payments, will seek guidance from U.S. Judge Thomas Griesa on what to do with the money, a source said on Wednesday. “Following an exchange of letters today, the court asked BNY Mellon to make a formal motion asking for clarification on what actions it should take with the money that the government deposited in its account at the Central Bank of Argentina last week,” said a source with direct knowledge of the situation.

Earlier Standard General had loaned its American Apparel shares to Charney, according to regulatory documents, allowing him to boost his stake in the company from about 27 percent to 43 percent. Charney had hoped to gain majority control, but American Apparel countered with an anti-takeover plan that prompted him to change his strategy. As a result, the 45-year-old American Apparel founder handed over his entire holdings to his ally Standard General, according to the sources, who requested anonymity because the talks are private. American Apparel declined to comment.

U.S. stock index futures ticked up in light volume on Thursday after the S&P 500 and the Dow industrials closed at a record, ahead of a short session on Wall Street that is packed with economic data. The unemployment rate is expected to remain at 6.3 percent. * Data on international trade, claims for unemployment insurance as well as two sets of numbers on the U.S. services sector are also due later on Thursday.

Once again, US equity futures are roughly unchanged (while Treasurys have seen a surprising overnight bid coming out of Asia) ahead of an avalanche of macroeconomic news both in Europe, where the ECB will deliver its monthly message, and in the US where we will shortly get jobless claims, ISM non-manufacturing, trade balance, nonfarm payrolls, unemployment, average earnings, Markit U.S. composite PMI, Markit U.S. services PMI due later.
